The Lifetime Care & Support Scheme is established under the Motor Accidents (Lifetime Care and Support) Act 2006.

This Act outlines the support available under the Scheme and the role of the Lifetime Care and Support Authority.

An amendment to the Motor Accidents (Lifetime Care and Support) Act 2006 was passed in October 2009. The Motor Accidents (Lifetime Care and Support) Amendment Bill 2009 includes the provision that a child will not be assessed for lifetime participation before the age of 5 years, which applies to current and future participants.

The 2009 legislation also includes a 'buy-in' provision to allow a person injured in a motor accident before the commencement of the Scheme to become a participant. An injured person may 'buy-in' if they meet the eligibility criteria and pay an amount determined by the Authority to fund the future treatment and care needs of the injured person. Buying into the Scheme is voluntary.
